It is always part of the divorcing parent the child custody who will have the full rights or can it be equal rights. Most rights will goes to the mother as the father always cannot be bother at all. In which the decision is favorable to the mother as it is what she likes to have the children.
Base on family code and child custody laws the child under 7 years old the custody will automatically goes to the mother and the father is ordered to provide support for the children. When the child reached 7 years old the child has given the right to choose to whom he or she chooses to live with. However if the child likes to live with father and the fathers intention to get the rights still his interest the can file for appeal. It is part of the requirements that the father can prove or show proofs that he has been sending support for his child. Considering the period from the divorce being granted until the present time in which he is filing for petition. But if the father neglect or proven as irresponsible father he will not be given any right at all towards the children. The custody will remain under the mother and the worse scenario is if the mother will file petition for the father to be taken rights to even see his children.
By law regarding child custody rights and the divorce decision plus the reason why it has been granted have significant effect on each case. In this effect the decision to have the full custody right will only be given to the parent that is responsible enough to take good care of the children. For example when the wife files for divorce and the decision was favorable to her; she will automatically get the full custody rights of the children. For the child custody right that has been granted in favor to the mother as she was proven to be a battered wife the husband loses his right automatically and cannot file any petition at all. Whatever the husband may act he need to respect the courts decision or the wife can put him in jail. The wife has all the rights to put the husband in prison even for only causing trouble or forcing her to bring out the children.
Therefore for the entire husband it is better to be if what the man is expected to be; a father, a husband and best if he can be her best friend as well. Only by imposing friendship that harmony in the family can be maintain and to avoid future filing of any documents that can be costly and time consuming for both parents.
